darryl02a.JPGCharges will not be filed against the driver who struck and killed a bicyclist last summer on Ridge Park Road, police said today.

Darryl Benefiel, 43, was killed when a car turning onto Tesoro struck him on his bicycle just after 5 p.m. on July 23. Lt. Craig Fox said police submitted the case to the Orange County District Attorney’s
Office, but they did not file any charges against the driver.

Meanwhile, The Daily Pilot is reporting that Benefiel’s mother has filed a wrongful death lawsuit against Newport Beach as well as the driver and the owner of the car that struck Benefiel. Read the Pilot story here.

Benefiel’s death was one of the factors in the city’s formation of a bicycle safety task force, which has met three times. Read our stories about the task force here, here and here.

A bicycle safety New Year’s Eve ride also is scheduled for 8 a.m. Thursday, meeting at Bandera. Read more about the ride here.
