		<description>In a past year, a Newport Beach police motorcycle tried to take down a New Year’s Day bicycle group.  The NBPD motorcycle officer argued that bicycles are not vehicles and must ride single file.  Newport Beach is vacillating on when cyclists are bicycles versus vehicles.  NBPD motorcycles have chased bicycles and subjected cyclists to lengthy detainments to contrive motorist citations.  For citation purposes, a bicyclist in Newport Beach becomes a motorist in a vehicle.  And judges at the Harbor Division court have ruled that bicycles on roadways are defined as vehicles. There is not such a definition in California statutes.  California has CVC 21200-212 that cyclists have the rights and duties applicable to motorists.  The OC Register recently quoted Traffic Sergeant Evan Sailor as saying “ We working with the court….”  Let’s be concerned about the collaboration of local police and municipal courts.  And let’s watch if the 2009 New Year’s Eve Bicycle Safety Ride has the rights of a vehicle or bicycle.</description>
