Puppy Shop Owner Seeks Restraining Order Against Activist

The owner of a Corona del Mar puppy store has filed for a restraining order against a Los Angeles woman who claims the shop sells dogs that come from puppy mills.

Brooke Ann Bradford filed a request for orders to stop harassment on Friday in Orange County Superior Court, according to online court records. A hearing is scheduled for 9:30 a.m. Aug. 10.

Carole Davis, West Coast director for the Companion Animal Protection Society, is named as the defendant. Davis has visited the store and alleged that at least one of the dogs there came from a Midwestern puppy mill. She also sent a letter demanding that the store stop selling dogs from breeders and convert to a shelter adoption business model.

Davis said last week that she had not received a response to that letter and warned that animal rights groups are planning to protest the shop at 2801 East Coast Highway. Newport Beach police said they were aware that protests and pickets could be taking place in the near future.

Bradford did not return an email seeking comment for this story.

Davis today said, “We have irrefutable evidence of the inhumane pet factories that supply her store. It will not work. I will not be intimidated and will continue to tell the ugly truth about I Heart Puppies.”

She referred other questions to her lawyer, Bryan Pease, who said she had not been served and was not clear whether a temporary restraining order already was in place. He said that Davis had not harassed the shop owners, however, and that she was within her constitutional right to free speech in her actions.

“She’s not harassing people,” he said. “She’s done this with hundreds of other pet stores. I’m 100 percent confident that she will prevail (in court), and the pet store will pay my attorney’s fees.”

Last week, the Corona del Mar Residents Association board declined to approve creation of a membership survey asking whether the Newport Beach City Council should create an ordinance banning pet shop sales of non-shelter animals. The Corona del Mar Business Improvement District board could discuss the issue at future meetings, however.

The I Heart Puppies shop opened July 1 and almost immediately drew national scrutiny from animal rights activists.

Isn't a restraining order to protect against bodily harm? Am I missing something, I was in the store with Carole to get breeder info and we had a soft spoken conversation with Ms. Bradford. When she realized who we were, her partner asked us to leave which we did. Carole then reported the truth about the breeders, they use PUPPY MILLS. They are pure evil these women, bad enough they support animal cruelty and lie about where their puppies come from but now they true greedy bitches. Sorry but they could have done the right thing and said "what can we do to fix this, we will be happy to be rescue only, help us? No, instead they continue to sell overpriced puppies that trust me in 6 months will have so many medical issues that a class action lawsuit will follow.

I suspect Ms. Bradford will be very busy filing restraining orders. Animal welfare advocates are stunned and outraged by the fact she opened a store that sells puppy mill dogs when this country destroys millions of healthy animal every year. I hope she understands her critics are only going to become more vocal.

Ahhhh, who cares!? She can file a suit against Carole, but that won't stop Carole's pack of loyal followers. It's a matter of time before this place will go down like the rest of them. They are just upset that they opened on 7/1, less than a month ago, and have already been shut down for not having the proper alarm system and that they are already getting this much scrutinity. They had to have known this was coming!! WHO OPENS A PET STORE IN 2011???? GET A CLUE! Better go humane before you dig yourself into a deeper hole. Hope you're reading this, I HEART Puppies.

This pet store can play all the games they want -- but this is just putting off the inevitable. We WILL be protesting this store in order to educate the public about the pet store/puppy mill link. Consumers need to be aware that puppy mill dogs like the ones sold in this store are very likely to have congenital health issues that will require extensive vet care.

Why am I not surprised! The cowardly Bradford first lies then denies then refuses to response to any emails, letters or phone calls then turns right around and frivolously uses up the resources and time of the court system to hide behind. If Bradford truly believed she was in the right she should have responded to any claims against her shop like an adult and defended her position (right or wrong) before using up the time of an already overburdened court system with her bogus, BS claim. The 'I Heart Puppies' shop owners have truly shown their true colors now and that is the color of money.

Why does she need a restraining order? What this does us bring more suspicion to her business. It makes me more curious about what the owner really knows about the puppies. She is hiding what we all know, Puppy Milll Offsprings! The publicity is making it worse and shows who she Is. Go humane and do adoptions like so many stores have not for years. Me thinks thee protesteth too much! A restraining order? Sounds like I Heart Puppies is trying to continue with its current business model and has no intention of fessing up to the puppy mill evidence. A restraining order against one person or one organization will NEVER prevent individuals from exercising free speech and free congregation. To the contrary, those sorts of legal shenanigans only make people more determined to be heard and seen.

I suppose no one should be surprised that people who would sell puppies from puppy mills and lie about it would stoop to something like this. These people can't suppress the truth, and they can't step on someone's right to free speech. Puppy Mills are like supporting modern day slavery. It won't prevail - I've protested with Carole and I know for a fact that she would never make a claim against a store that supports puppy mills unless it was true. We were protesting outside a puppy store here in Norwalk, Ct and were told the story by a man who stopped about the puppy he bought for his son, it died 8 days later- his son was traumatized, the store refunded the cost of the puppy but it was before the puppy lemon law was in effect and he was left with $1,000.00's in vet bills. Protesters cannot warn the consumer and these store owners can lie and lie again across this country?

Bradford is going to need hundreds of restraining orders if she thinks she can silence the ugly truth about her store. It's not just one breeder. ALL of her breeders are puppy mills and she thinks that breeding moms living in cages for life is just fine. I think she should go and live in a wire cage under USDA standards of care. I don't understand why pet stores want to sell puppies or kittens. These stores are smelly and customers just go in to look like it's a free zoo. I am sure these stores would make more profit focusing on organic food and other pet expensive accessories. Really, how many people buy $2,000 pets during this recession? There are approximately 15,000 puppy mills, one within 20 miles of every household. They breed approximately 4 million dogs a year, while millions are put to death in shelters. The breeding mothers are kept in tiny, filthy cages their entire lives. They receive little or no veterinary care, grooming, or human affection. All in what we call a civilized nation. These shop owners are deceiving people into believing that the dogs they are selling actually come from "reputable" breeders - and potential customers might believe that these dogs are coming from the very same breeders who show their dogs at Westminister and other dog shows around the country. POTENTIAL CUSTOMERS NEED TO KNOW THAT ***REAL*** REPUTABLE BREEDERS WHO SHOW THEIR DOGS WOULD {{{{{NEVER}}}} SELL THEIR PUREBRED AKC PUPPIES TO A PET STORE!!!! The breeders who provide dogs to pet stores are ***COMMERCIAL BREEDING FACILITIES***, that are overseen by the USDA just like cattle and pigs -- and, that is how the dogs are raised. THESE BREEDING ESTABLISHMENTS KEEP FEMALE DOGS STACKED UP IN CAGES ON TOP OF ONE ANOTHER (MANY OUTSIDE IN THE FREEZING COLD), LIVING ON WIRE GRATES, WHERE THEIR PAWS NEVER TOUCH GRASS AND IMPREGNATING THEM OVER & OVER AGAIN UNTIL THEY CAN NO LONGER PRODUCE PUPPIES FOR THE OWNERS WHO ARE MAKING A LIVING ON THE BACKS OF THESE POOR TINY DOGS WHO ONLY PRODUCE 1-2 PUPPIES PER LITTER! The "breeder moms" are NOT GIVEN ANY MEDICAL, their nails grow into their paw pads because it is too much work to trim the nails of 100 dogs - and why bother? They are serving their purpose to these so-called "breeders", sick or not - as long as they can produce litters of pups, they are kept alive. MANY HAVE SEVERE EYE INFECTIONS AND ALL HAVE ROTTED TEETH! Did I mention that they are ALL DE-BARKED BY A FARMHAND SHOVING A SCISSOR OR SCREW DRIVER DOWN THEIR THROATS TO MANGLE THEIR VOCAL CORDS?? Otherwise, can you imagine the noise of 100 dogs, all barking and yelping, non-stop 24/7 because they are in pain and unhappy from having to pee and poop through a wire grate - injuring themselves from falling through the holes half of the time? I am NOT making this up! I fostered one of these dogs, who was rescued. She had been debarked in the most horrible way which left a huge lump in the front of her tiny throat and her rear legs barely functions because she had fallen through the wire grates of her cage and dislocated both of them, which were never repaired! She was a tiny Shih-Tzu that only weighed 8 lbs and the majority of her life was spent in pain, on her side, pushing out her one puppy litter OVER & OVER AGAIN. SO, PEOPLE - THE NEXT TIME YOU SEE A CUTE LITTLE "PUPPY IN THE WINDOW" - NOW YOU WILL {{{{KNOW}}}} WHERE IT CAME FROM - AND THE SUFFERING OF THE FEMALE DOGS THAT WENT INTO THE ***PRODUCTION*** OF THAT CUTE LITTE, CLEANED UP PUPPY!!! And, just how healthy do you think that little puppy IS, coming out of a stressed out, sick, overbred female who was probably impregnated by her own brother!? DON'T SHOP -- ADOPT! And, if you MUST have a dog that comes with AKC papers, go to a REAL breeder - one who shows his/her dogs at dog shows - does a home check - and will always accept the dog back into his/her pack, if the new owner can no longer care for it.

The overpriced puppies she is selling will have many health concerns in the near future. And every breed of dog is found right now in your local shelters. I'd like to know how many of the 100 plus people who have posted on these various puppy articles actually live in CDM - and if you do - where are you people when it comes to issues of REAL concern like jets flying over CDM, traffic, crime, beach hours, DOGS unleashed on the beaches and DOG pee all over the Ocean Blvd toilet/park and real quality of life issues. Frankly I think it's criminal that so many residents in CDM keep big dogs cooped up in little condos.

Carol Davis is one of the best people you could ever imagine! The horror stories of puppy mills are known far and wide. Anyone who doesn't know about them may very well be living under a rock. These clueless fools who own this horrifying pet store had the nerve and the ignorance to move from Utah to open in Southern California, and they think people aren 't going to stand up against the animal abusing puppy mills they're in bed with? A restraining order? What for? You can't expect to sell puppy mill dogs and get away with it. Lots of people are educated about puppy mills, or went through the horror of getting sick dogs from a pet shop. These women never set foot in where their live 'merchandise' is coming from. I'm absolutely flabbergasted to why they're allowed to operate in what is considered a highly educated 'affluent' neighborhood. Do locals know about puppy mills? At least SOME must have watched the (very tame, and very 'safe for TV') Oprah show on puppy mills...if not, they need to just google 'puppy mills' . Instead of making the changes to have a humane pet store, Bradford takes legal action against me. This will never work because, A, I am just the messenger for a national org that investigated the breeders she buys from, and B, her action has no basis in fact. <> <> The facts are simple: This store sells animals from factories where the dogs live in wire cages, outside in the freezing cold with no bedding, no socialization for their entire lives. We were lucky (if you can call it that) to find out that one of her breeders actually tied up a Golden and shot her in the head on the very same day as a USDA inspection. We are pursuing that with the DA there and the USDA. We also have proof that at least 5 of her breeders are puppy mills. CAPS gets inside these places and provides evidence to the authorities. <> <> <> I do not engage in illegal activity. We work with law enforcement, government agencies and lawmakers around the country every day. Contrary to what Bradford claims, I do not want to close down any store (s). I want Bradford to change her business model and to please stop selling animals that are manufactured like machine parts. <> <> <> At this point, the name of her store, I Heart Puppies, is false advertising. There are laws in CA against false advertising.

At what point does speaking the truth in a professional manner become "harassment"? At what point does exercising one's right to free speech and peaceful assembly become legally actionable? City council members and citizens please read the article published about opening of I HEART Puppies. In that article, by their own admission/statement these women chose Corona del Mar to open their for profit front for misery and suffering because the laws in a neighboring township "were to difficult to negotiate". This does not speak well of those in the local government responsible for the passage (or lack of) those laws concerning for profit companion animal sales. I hope the citizens of Corona del Mar and their elected representatives recognize this case is being closely watched by animal welfare activists nationwide.These women are making a profit off the suffering of the breeder dogs kept in the puppy mills. The harrassment of licensed lawful pet stores and commercial breeders has got to stop. Shelters are deliberatly lying about the conditions of these places for their own greed. They want to put these legitimate businesses out of business so they can become the new pet store. Why is it okay for them to keep dogs in cages etc and sell to the public? They aren't even regulated like pet stores and commercial breeders. This is the US and the public is not evil when they have a particular breed they enjoy and want. STOP this insanity!

What is the USA coming to? NO free trade? Only certain groups have the right of expression? Only if you agree with fanatics are you right? As for the overabundance of dogs in the shelters, then explain why so many groups are importing from Mexico, Russia, China, etc? Explain WHY a consumer doesn't have the right to purchase the dog they WANT. WHY do they have to take one that someone else has screwed up? Think - WHEN there's no breeding - where will the next generation of dogs come from? Miraculous conception? Get real! This is restraint of free trade! Follow the $$ - these "rescues" and shelters are making a BUNDLE. And - amazing - many of the shelters have Union employees???? WOW - never saw a Union that didn't want to INCREASE their numbers!!!

THIS IS AMERICA.. if you want to protest.. do so.. lawfully and within the guidelines of your local community BUT these people are doing nothing wrong. They are in a legitimate business.. don't like it.. don't go there. I have been to several commercial kennels.. all clean, dogs in great condition and puppies healthy and lively.. my bet is that NONE of these people who are so vociferous have even been out side of their own wealthy white woman conclave where they conspire to force bushiness to conform to their own idea of "legitimate" and force them sell a product that THEY think is worthwhile.. while you scream about sick puppies from "puppy mills".. take a look around at your shelter conditions..and the health of those dogs.. then come back and tell us all is well. clean up your own act first.. take a look at the "shelters" in LA.. conditions that would make a real puppy mill look like a palace,

Looks like a legitimate business owner is concerned and exercised her right under the law NOT to be intimidated while running a legitimate business. Really? This Carol person is so all knowing about where the puppies came from? Or does she have the usual anti-pet animal extremist agenda? People such as Carol are tiresome, ignorant bullys and need to be stopped. I have yet to meet an animal extremist who cares about animals, what they do care about is their holy agenda of ending pet ownership. So Carol - go away, get some help to deal with your pet hating issues, and leave the real animal lovers alone.
